Challenging OTC Assessments

When the Oklahoma Tax Commission issues an assessment you believe is incorrect, you have the right to challenge it through administrative procedures. Understanding the protest process helps you protect your interests and potentially reduce or eliminate the assessed liability.

Assessments follow audits or result from OTC-prepared returns when you haven’t filed. Either way, you’ll receive a notice identifying the assessed tax, penalties, and interest. Review this notice carefully to understand what’s being claimed and the basis for the assessment.

The first step is identifying what’s wrong. Assessments can be incorrect for many reasons. The OTC may have miscalculated your liability, included income that shouldn’t be taxed, disallowed legitimate deductions, or made computational errors. Pinpointing the specific problems focuses your challenge on issues that matter.

File a written protest within the time specified in your notice. Oklahoma law requires protests to be filed within a specific period, typically 60 days. Missing this deadline can forfeit your right to administrative review.

Your protest should identify the specific items you’re disputing, explain why the assessment is wrong, and request the relief you’re seeking. Vague objections like “I disagree” aren’t effective. Provide specific facts and legal arguments supporting your position.

Include supporting documentation with your protest. Records that demonstrate your position are more persuasive than unsupported assertions. If you’re disputing income, provide records showing actual income. If you’re challenging disallowed deductions, attach documentation supporting those deductions.

The OTC will assign your protest to a reviewer who will evaluate your arguments and supporting evidence. You may receive requests for additional information or be scheduled for a conference to discuss the issues.

If the protest doesn’t resolve the dispute favorably, you can appeal to the Oklahoma courts. The decision to escalate depends on the amounts involved and the strength of your legal position.
